Welcome to The Lazy Agent CRM, operated by Tommy Mutchler, LLC (“The Lazy Agent,” “we,” “us,” or “our”). By accessing or using our services, you (“you,” “user,” “customer”) agree to these Terms of Service and our Privacy Policy. Please read them carefully.

1. Acceptance of Terms

By creating an account, purchasing a subscription, or using The Lazy Agent CRM, you agree to be bound by these Terms of Service and any additional terms or policies referenced herein. If you do not agree, do not use our services.

We may update these Terms at any time. We’ll do our best to notify you of significant changes, but your continued use of our services after changes are posted means you accept the new terms.

2. Product Overview & Subscriptions

The Lazy Agent CRM is a software platform designed for real estate agents, teams, and brokers. Your subscription may include access to our CRM platform (built on the GoHighLevel system), done-for-you automations, The Lazy AI, campaign templates, funnels, websites, and other features as described on our website.

We offer monthly, quarterly, every six months, and annual subscription options. All subscriptions renew automatically at the end of each billing cycle unless you cancel in advance.

How to Cancel:
You are responsible for canceling your subscription. Cancellations must be completed by logging into your account, navigating to “Billing,” and following the instructions to cancel. Contacting support or sending an email does not constitute a valid cancellation.

No partial refunds are provided for unused time or services unless specifically stated otherwise.

3. Third-Party Integrations & Add-Ons

The Lazy Agent CRM may integrate with or require additional products and services such as Real Homes IDX, GoHighLevel, Zapier, OpenAI, or others. Some features or integrations require separate subscriptions or additional fees, which will be clearly indicated before purchase.

Important:

  • Real Homes IDX is a separate subscription and is not included in the base CRM package.
  • Any other integrations, add-ons, or premium services may require separate purchase or subscriptions and are governed by their own terms and fees.

We may share necessary data with third-party providers to deliver these integrations and functionalities. Your use of third-party services is also subject to their individual terms of service and privacy policies.

4. Usage Credits

Some features in The Lazy Agent CRM—such as emails, text messages, AI automations, and certain integrations—require the use of credits. These credits are purchased separately and are available on a pay-as-you-go model.

  • Credits do not expire and will roll over from month to month.
  • Unused credits remain in your account until used, unless your account is canceled or terminated (see Section 7).
  • Credits may only be used within The Lazy Agent CRM and are not transferable or refundable.
  • Purchasing and using credits is subject to all other terms in this agreement.

5. Support & Onboarding

We pride ourselves on providing real, human support to our customers:

  • Support is available 24/7 via live chat and Zoom at support.thelazyagent.com.
  • No email support is offered. All support requests must be submitted through our support portal.
  • One-on-one onboarding is available to help you set up your CRM, but you are ultimately responsible for completing all required training videos and setting up your account.
  • We also offer weekly office hours calls with Tommy for additional support, advice, and troubleshooting.

6. User Responsibilities

By using The Lazy Agent CRM, you agree to:

  • Follow all local, state, and federal laws—including but not limited to the Telephone Consumer Protection Act (TCPA)—regarding communication, marketing, lead generation, and outreach.
  • Never use our platform for illegal activity, spamming, unsolicited or unlawful outreach, or any activity that would violate laws or the rights of others.
  • Obtain explicit, documented consent from your leads or contacts before sending cold texts, voicemails, calls, or any automated communications.
  • Export your own data and leads before canceling. Once your account is canceled, your data will be permanently deleted (see Section 7).
  • Respect all usage limits and platform rules described in these Terms.

Violation of any of these responsibilities may result in immediate account suspension or termination, at our sole discretion.

7. Account Termination & Data Deletion

You may cancel your subscription at any time by logging into your account and following the cancellation instructions under “Billing.”

  • Immediate Deletion: Upon cancellation, your account and all associated data—including leads, contacts, automations, and campaign history—will be deleted immediately and cannot be recovered.
  • Data Export: You are responsible for exporting any data you wish to retain before your account is canceled.
  • Transfers:
    • If you wish to transfer your website to another GoHighLevel account, a one-time $250 transfer fee applies.
    • Transferring phone numbers is available for a one-time $250 fee.
    • Sub-accounts, automations, and custom setups will not be transferred to other GoHighLevel platforms.
  • Our Right to Terminate: The Lazy Agent reserves the right to suspend or terminate your account at any time, for any violation of these Terms of Service or for any unlawful or abusive behavior.

8. Refund Policy

We maintain a strict no-refund policy:

  • No refunds are provided for subscriptions, credits, add-ons, or any additional purchases—except where explicitly stated otherwise in a specific offer or promotion.
  • All purchases of credits, integrations, add-ons, or separate services (such as Real Homes IDX) are non-refundable under all circumstances.
  • Partial months or unused portions of subscriptions or credits will not be refunded.
  • Chargebacks or payment disputes may result in immediate suspension or termination of your account and loss of access to all services and data.

9. Intellectual Property

All software, automations, templates, branding, training materials, and content provided through The Lazy Agent CRM remain the exclusive property of Tommy Mutchler, LLC dba The Lazy Agent.

  • You may use our platform and content solely for your own real estate business as intended.
  • You may not copy, resell, distribute, reverse-engineer, or create derivative works from our platform, automations, or materials without our written consent.
  • Unauthorized use or sharing of our intellectual property may result in account termination and legal action.

10. Earnings & Results Disclaimer

The Lazy Agent CRM and any products, services, templates, automations, webinars, training, social media posts, case studies, or marketing materials provided by Tommy Mutchler, LLC dba The Lazy Agent (collectively, “The Lazy Agent”) are intended to assist real estate professionals with automation, organization, and efficiency. However, your individual results will vary, and there are no guarantees of income, clients, sales, or success.

Specifically:

  • Any information, results, or figures shown in our marketing materials, webinars, videos, emails, social media posts, or other communications—including testimonials, success stories, case studies, and “before and after” examples—are for illustration and informational purposes only. They represent the experience of specific individuals and are not promises, guarantees, or typical results.
  • No content provided by The Lazy Agent should be interpreted as a guarantee, promise, or warranty of results. Past performance does not predict future results.
  • Your results are entirely dependent on factors including your skill, effort, implementation, market conditions, client demand, compliance with laws, and variables outside of The Lazy Agent’s control.
  • The Lazy Agent does not offer legal, tax, financial, or real estate advice. You are solely responsible for your own business decisions and compliance with all applicable laws and regulations.
  • By using The Lazy Agent CRM or any related services, you acknowledge and agree that you are solely responsible for your own success, revenue, and results in your business.
  • We strongly recommend that you conduct your own due diligence and consult with your own professional advisors before making business decisions or investments based on any information received from The Lazy Agent.

In summary:
There are inherent risks in any business or marketing endeavor. The Lazy Agent makes no express or implied claims of guaranteed earnings or outcomes. Use of our services is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Lazy Agent, its owners, employees, contractors, and affiliates are not liable for any direct, indirect, incidental, consequential, or special damages arising out of your use or inability to use the platform—including lost data, lost business, lost profits, or other losses.
  • Our maximum liability, if any, is limited to the amount you paid to The Lazy Agent in the previous twelve (12) months.
  • The platform is provided “as is” and “as available” without warranty of any kind, express or implied.

12. Dispute Resolution & Governing Law

  • These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law principles.
  • Dispute Resolution: Any disputes or claims arising out of or relating to these Terms, your subscription, or use of The Lazy Agent CRM will be resolved exclusively by binding arbitration in Whatcom County, Washington. You waive your right to participate in a class action or jury trial.
  • You agree to first attempt to resolve any issues with us informally by contacting support.
  • Any chargebacks or payment disputes not first resolved with us directly may result in immediate account suspension or termination.

13. Amendments & Updates

The Lazy Agent reserves the right to update, modify, or change these Terms of Service at any time.

  • We will do our best to notify users of significant changes via email or through in-app notifications, but it is your responsibility to review the Terms periodically.
  • Continued use of The Lazy Agent CRM after changes are posted constitutes your acceptance of the new Terms.

14. Privacy & Data Sharing

Your privacy and data security are important to us.

  • To provide our services, we may share data with trusted third-party providers and integrations—including but not limited to GoHighLevel, Zapier, OpenAI, and other partners—strictly as needed for functionality.
  • Use of these third-party services is governed by their respective privacy policies and terms of service.
  • For details on how we collect, store, use, and protect your data, please refer to our Privacy Policy.
